1. Scope

By using our website and purchasing an analysis, you agree to these Terms & Conditions. Deviating conditions of the user are not recognized. Our services are intended exclusively for adults (over 18 years of age).

2. Service, "Best Effort" and AI Error Proneness

SuperDave offers an AI-supported analysis of construction site photos (e.g. for defect detection) as a one-time purchase. After uploading the photos, processing takes place in the background, and the results are sent to the provided email address.

The service is provided on a "best effort" basis. Artificial intelligence is naturally prone to errors. The analysis reports may overlook defects, misinterpret them, or invent non-existent errors (so-called "hallucinations"). The AI analysis is a non-binding technological tool and in no case replaces a professional on-site inspection by experts, architects, structural engineers, or legal advisors.

3. User Obligations and Image Rights

You are responsible for ensuring that you are authorized to transmit the uploaded photos to us (copyrights, consent of depicted persons, property rights of the builder).

By uploading, you grant Refind Inc. the right to process the photos to provide the service. As described in our Privacy Policy, you also grant us the free right to use the uploaded images to train our AI models, improve our services, and in anonymized form for our own marketing purposes.

4. Prices and Payment Terms

The prices stated at checkout apply. The purchase price is due immediately and processed via our payment provider (Stripe).

All prices shown are final prices. As we are not currently subject to VAT, no Swiss VAT is charged or displayed.

5. Right of Withdrawal

Since the AI analysis involves the immediate provision of digital content, you expressly agree that we begin executing the service before the expiration of the statutory withdrawal period. Your right of withdrawal therefore expires immediately upon the start of the analysis. Further information can be found in our Right of Withdrawal Policy.

6. Maximum Limitation of Liability

The customer uses the analysis results entirely at their own risk. Due to the inherent error rate of AI systems, we assume no liability, guarantee, or warranty for the accuracy, completeness, or usability of the generated results.

Refind Inc. shall only be liable without limitation in cases of intent (willful misconduct) and gross negligence. Any liability for slight negligence is fully excluded. To the maximum extent permitted by law, we shall under no circumstances be liable for direct or indirect damages, consequential damages, construction delays, loss of profit, or damages resulting from construction- or planning-related misjudgments made based on our analysis reports.

The service and its AI-generated analysis are provided "AS IS" and "AS AVAILABLE" without any warranties of any kind. To the maximum extent permitted by law, Refind Inc. completely disclaims all warranties, express or implied, and limits its liability for any claims whatsoever arising from the use of the service to the amount paid by the user for the specific analysis.

7. Applicable Law and Jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is the registered office of Refind Inc. (Egg SZ, Switzerland), unless mandatory statutory provisions (in particular consumer protection laws in the customer’s country of residence) strictly prescribe a different place of jurisdiction.
